en-EN baner-www 01The mayor of the town of Łuków 17 Piłsudskiego St., 21-400 Łuków announces the first open oral tender for the sale of: the ownership right of the below mentioned unimproved real estate owned by the town of Łuków, located in Łuków at Łapiguz St. and at Strzelnicza St. within Łuków Subzone of Tarnobrzeg Special Economic Zone.

1. The real estate located at Łapiguz St. marked as the plot of land No. 1256/17, area of 4.0825 hectares (Land and Mortgage Register No. LU1U/00054273/6). The starting net price for the real estate is PLN 1 614 220 (23% of VAT tax will be added to the price).
2. The real estate located at Łapiguz St. marked as the plot of land No. 1256/19, area of 2.6095 hectares (Land and Mortgage Register No. LU1U/00054273/6). The starting net price for the real estate is PLN 1 031 800 (23% of VAT tax will be added to the price).
3. The real estate located at Strzelnicza St. marked as the plot of land No. 1256/20, area of 2.2388 hectares (Land and Mortgage Register No. LU1U/00054273/6). The starting net price for the real estate is PLN 885 220 (23% of VAT tax will be added to the price).
4. The real estate located at Strzelnicza St. marked as the plot of land No. 1258/3, area of 0.9876 hectares (Land and Mortgage Register No. LU1U/00054273/6). The starting net price for the real estate is PLN 390 500 (23% of VAT tax will be added to the price).

In the local area development plan the above mentioned real estate are located:
- the real estate listed under point 1 and point 2 in the area intended for the realization and maintaining of the production premises, storages and warehouses with a high proportion of cultivated green areas marked on the plan's sketch with PZ1 symbol,
- the real estate listed under point 3 and point 4 in the area intended for the realization and maintaining of the production premises, storages and warehouses with a high proportion of cultivated green areas marked on the plan's sketch with PZ2 symbol.

The real estate are located within Tarnobrzeg Special Economic Zone. The zone administrator, i.e. Industrial Development Agency S.A. (Agencja Rozwoju Przemysłu S.A.) holds the right of pre-emption.

A Purchaser must have the authorization to carry on the activities in the area of Łuków Subzone of Tarnobrzeg Special Economic Zone or he/she shall be obliged within a year from the day of signing the contract of sale to start in the area under discussion the investment that is consistent with the local area development plan and to complete it until the end of year 2018. In the case of a failure to comply with this obligation, the town of Łuków will call up a Purchaser and will set an additional time limit. Upon the expiry of the additional time limit, the town of Łuków will have the right to repurchase this real estate within the year immediately following the expiry of the additional time limit.

The plots of land No. 1256/17 and No. 1256/19 are the subject of the lease contract No. GNP.6845.64.2013 of 31st of December 2013 which is valid until 30 December 2015. The real estate No. 1256/20 and No. 1258/3 are not subject to any liens. The real estate have the access to the public road. The deadline for the submission of the application by persons who have the priority right in acquisition of the real estate pursuant to Article 34, section 1, item 1 and item 2 of the Act of 21 August 1997 on real estate management (consolidated text, Journal of Laws of 2015, item 782) expired on the 1st of June 2015.

The tender procedure will be held on the 22nd of September 2015 at 10.00 a.m. in the Municipal Office of Łuków at 17 Piłsudskiego St, in the conference hall.

The condition for the participation in the tender procedure is the deposit of a bid security in money, providing the forename, the surname and address of residence or the name and company's registered office and the plot of land number, in the amount of: PLN 300 000 (in words: three hundred thousand Polish zlotys) for the real estate at Łapiguz St. (point No. 1); PLN 200 000 (in words: two hundred thousand Polish zlotys) for the real estate at Łapiguz St. (point No. 2); PLN 170 000 (in words: one hundred and seventy thousand Polish zlotys) for the real estate at Strzelnicza St. (point No. 3); PLN 77 000 (in words: seventy seven thousand Polish zlotys) for the real estate at Strzelnicza St. (point No. 4) paid on the bank account of the town of Łuków No. 84 9206 1048 7103 0300 2000 0160 Bank Spółdzielczy in Trzebieszów, at the latest by the 16th of September 2015. The date of transferring money on the specified bank account of the town of Łuków is decisive. The payment of the bid security means being acquainted with the conditions relating to the tender procedure and acceptance of these conditions.

The foreigners wishing to purchase a real estate should hold on the day of the tender a permit or a promise from the competent minister for internal affairs under the pain of being refused to participate in the tender, excluding the foreigners who are exempted from this obligation under the Act of 24 March 1920 on the acquisition of real estate by foreigners (consolidated text, Journal of Laws of 2014, item 1380).

Persons who submit to a tender should present a valid identity document. Persons who represent in a tender a legal entity or a natural person are obliged to present the full set of documents that are necessary for representing. The participants take part in a tender in person or by a legal representative (there is a requirement of the power of attorney in the form of a notarial deed).

Detailed conditions of the tender are specified in the regulations available at the Municipal Office of Łuków, 17 Piłsudskiego St. or at the website http://umlukow.bip.lubelskie.pl.

The bid security paid by a person who will win a tender will be credited towards the purchase price of the real estate and in case of evading the conclusion of the notary agreement by this person the bid security shall be forfeited. In the remaining cases the bid security will be returned no later than within 3 days from the date of, respectively: cancellation, closing the tender, invalidation or its completion with a negative result.

The real estate are sold on the basis of the data from land and building registers as well as land and mortgage registers. Geodetic presentation of the borders of real estate that are to be sold is possible at the purchaser's expense and request upon earlier payment of geodetic costs.

The mayor of the town of Łuków shall not be responsible for any potential underground land utilities that have not been indicated on the existing maps.

The protocol from the conducted tender constitutes a legal basis for the conclusion of a notarial deed.

The selling price and the VAT tax (23% VAT) are subject to one-off payment no later than 3 days before the conclusion of a notarial deed.

The purchaser of a real estate shall bear all fees and taxes, notary costs, court fees and other costs connected with the transfer of ownership of a real estate.

The mayor of the Town of Łuków reserves the right to cancel the tender only for valid reasons.
